General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers via the webshop of Kaufweise UG (limited liability) under the domains kaufweise.de, kaufweise.nl, kaufweise.com and sprayhflasche.com as well as via third-party platforms (e.g. eBay, Etsy), unless the platform has different terms and conditions.
The inclusion of the customer's own terms and conditions is rejected, unless otherwise agreed.

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Buy" button (or a corresponding, clearly worded phrase such as "Order with obligation to pay"), you submit a binding order for the goods contained in the shopping cart.
Confirmation of receipt of your order will be sent immediately by email after you submit it; this does not yet constitute acceptance of your order. We can accept your order by sending a separate order confirmation by email or by delivering the goods within two business days.
3. Prices and duties
The prices listed on the product pages are final prices. They include the statutory value added tax.
Note for international deliveries:
For deliveries to countries outside the European Union (especially via kaufweise.comIn individual cases, additional costs may arise that are beyond our control and must be borne by you. These include, for example, costs for money transfers by credit institutions (z.BTransfer fees, exchange rate fees, or import duties and taxes (customs duties) may apply. Such costs can also be incurred in connection with the money transfer even if the delivery is not to a country outside the European Union, but you are making the payment from a country outside the European Union.
4. Shipping costs, delivery terms, packaging register
Shipping costs and delivery conditions are detailed on our website under the heading "Shipping Information" for the respective delivery areas (DACH, Benelux, International).
We comply with our packaging regulations. Our packaging is registered in the Lucid Packaging Register (Central Agency Packaging Register Foundation) and we participate in a dual system (e.g., Green Dot).

5. Payment terms
We accept various payment methods (e.g., Shopify Payments, PayPal, credit cards, bank transfer), which vary depending on the chosen country domain (kaufweise.deThe website (.nl/.com) and currency may vary. The specific options will be displayed during the checkout process. Payment is due immediately upon conclusion of the contract.
6. Right of withdrawal and return shipping costs
Consumers generally have a right of withdrawal. Further information regarding the right of withdrawal can be found in the cancellation policy.
Cost sharing agreement for returns:
If you exercise your right of withdrawal, you will bear the direct costs of returning the goods.
This also expressly applies to returns from abroad (cross-border trade). Please note that the costs for returns from abroad (especially from non-EU countries via [unclear]) kaufweise.com) depending on the shipping provider and country, these costs can be considerably higher than domestic shipping costs.
7. Return and compensation for loss of value
The right of withdrawal does not expire prematurely if the goods have been unpacked or inspected. However, you must compensate for any diminished value of the goods if this diminished value is due to handling of the goods that was not necessary for testing their condition, properties, and functionality.
Please avoid damaging or soiling the goods. If possible, please return the goods to us in their original packaging, including all accessories and packaging materials. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against damage during transport by using suitable packaging.

We process your personal data for contract fulfillment. Since we also ship internationally, data may be transferred to shipping providers in the respective delivery country. Further information can be found in our privacy policy.
10. Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Final Provisions and Choice of Law
All legal relations between the parties shall be governed by the law of the Federal Republic of Germany, excluding the laws on the international sale of goods (UN Sales Law).
Special note for consumers abroad (principle of most favorable treatment):
For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence (Art. 6 para. 2 Rome I Regulation). This applies in particular to customers of our shop. kaufweise.nl (Netherlands) and other EU countries.
The place of jurisdiction is, insofar as the customer is a merchant, a legal entity under public law or a special fund under public law, the registered office of Kaufweise UG.
